Terms & Conditions

These are the T’s and C’s. They’re pretty straightforward and I hope we never need to use them to settle a falling-out. Basically what they say is:

  • If you’ve ordered the right thing and I’ve sent you the wrong thing, I’ll take it back.
  • If I’ve sent you what you ordered, I can’t take it back.
  • If it arrives damaged or gets lost in the post, I’ll replace it.
  • If it won’t be ready in time for your birthday but I told you it would be, you can cancel your order and have a refund.
  • I won’t pass your details on to anyone.

‘I’ refers to Simon Brock trading as Simon Brock Handmade Leather Goods

‘You’ refers to customers or potential customers of Simon Brock Handmade Leather Goods

‘The website’ refers to www.madebysimonbrock.co.uk

All transactions made via www.madebysimonbrock.co.uk – including orders placed over the phone or by e-mail based on the information provided on the website – are subject to The Consumer Contracts Regulations (2014), which incorporates regulations covering Distance Selling. The Terms and Conditions below apply for all such transactions, as well as purchases and orders made in person at fairs, exhibitions etc.

Placing Orders and Cancellation

I aim to fulfil all orders within the time frame given in the ‘Buying & Ordering’ section of the website under the ‘Custom Orders’ subheading, which is updated frequently and varies depending on demand, volume of work etc., and which will also be communicated verbally in the case of orders taken over the phone or in person.

Whilst this estimate is given in good faith, it is only an estimate and can vary due to the labour intensive nature of the work involved. If I estimate that orders placed on a given day are unlikely to be completed before a particular date which is likely to be important for customers e.g. in time for Christmas, this information will also be published in the ‘Buying & Ordering’ section of the website and in the ‘Cart’ and/or ‘Checkout’ sections of the website.

If you have not contacted me to discuss a deadline, I will accept no responsibility for loss, damage, embarrassment, inconvenience etc. caused by an order taking longer than the published estimated lead time to fulfil; or caused by an order arriving after any specific date if I have advised you verbally, by e-mail or through appropriate warning on the website that the order will not or is unlikely to be delivered before that date.

If for any reason it becomes apparent that an order will not be completed before any date which we have agreed as a deadline, I will contact you and you will have the option to cancel your order and receive a full refund.

Unless agreed otherwise in writing, payment must be made in full by cheque, PayPal or direct transfer before any order is dispatched (in the case of orders placed online, by e-mail or by phone); or by cash or credit/debit card (in the case of orders placed in person). Please allow up to 5 working days for cheques to clear. Goods remain the property of Simon Brock Handmade Leather Goods until payment is made in full.

I will contact you when your order is completed and ready to be dispatched so that we can arrange a delivery date and address.

Any order for an item or items from stock can be cancelled at any time from placing the order until seven working days after you receive your order. In such circumstances you will receive a refund of any payment already made minus bank/PayPal charges. At my discretion, you may be able to cancel an order for a custom, bespoke or commission item, provided that work has not begun on the item; and provided that I have incurred no costs in obtaining materials in order to make the item that cannot be used in the manufacture of other items. You should contact me to discuss cancelling an order for any item not bought from stock.

Deposits

A deposit for a bespoke or custom item is to cover the cost of materials, and is therefore non-refundable. Unless agreed otherwise in writing, the balance must be paid in full by cheque, PayPal or direct transfer before any order is dispatched. Please allow up to 5 working days for cheques to clear. Goods remain the property of Simon Brock Handmade Leather Goods until payment is made in full.

Delivery

Unless agreed otherwise, orders which include leather goods will be delivered free of charge Monday – Friday by Royal Mail Special Delivery to any geographical address in the UK, Isle of Man and Channel Islands. Saturday delivery will incur a £3.00 charge.

Orders which consist exclusively of aftercare products will incur a delivery charge of £2.50 per item. Aftercare products ordered as part of a larger order will be delivered free of charge as above.

I reserve the right to charge extra postage and packing costs for any commission item or bespoke item made to order which does not fit in one of the boxes which I have in stock; for which it is necessary to make or order bespoke packaging; or which weighs more than the heaviest item advertised on the website.

Sending items by Special Delivery means that in the majority of cases the item will arrive on the day we have agreed. However, the operation of Royal Mail is outside my control, so I will accept no responsibility for loss, damage, embarrassment, inconvenience etc. caused by items arriving on a different day. You should, however, inform me as soon as possible if an item doesn’t arrive on the date we agreed.

Overseas postage will be charged at cost and you should contact me before placing an order as there is no option to select overseas postage via the online shop. I will accept no responsibility for loss, damage, embarrassment, inconvenience etc. caused by overseas orders being held up by customs or being delayed for any other reason. You are responsible for all customs and import charges and any other charges arising, so please carefully check the regulations which apply to your country.

Returns

If you are unhappy with any item purchased from stock, you can return it within 7 working days and you will receive a full refund of the original cost of the item, provided that it is returned in its original packaging, and in completely unused condition. In these circumstances return postage will be at your cost. Please ensure that the item is tracked and insured to guarantee its safe return, as items lost in transit will not be refunded and the cost of damaged packaging will be deducted from any refund given.

If an item arrives damaged or is lost in transit, you will have the option either to receive a full refund or for a replacement item to be sent as soon as is practical. You should inform me as soon as possible if an item doesn’t arrive on the date we agreed as I will need to pursue this with the carrier. In case of goods arriving damaged I will ask you to return the item but your return postage will be reimbursed.

I reserve the right to refuse to give a refund for any commission item, bespoke item, or any item from the range of goods advertised on the website which is made to order unless it arrives damaged or, due to error on my part, does not meet the specification of the order which you placed (e.g. wrong stitching colour, wrong strap length etc.).

Items cannot be returned on the basis of natural variations in the leather or because the colour of leather or stitching is not what you expected; samples can be ordered via telephone, e-mail or the website to avoid confusion and I will answer honestly any questions you may have about the product before placing an order.

Dimensions given on the website are approximate and refer to the widest/tallest/deepest external dimensions of the product, not the internal dimensions. If you have a specific use in mind for which internal dimensions are crucial, you should get in touch to discuss this before you order. Items made to order cannot, therefore, be returned on the basis of being the wrong size.

Privacy Policy

By making a purchase from Simon Brock Handmade Leather Goods, you agree that I may use and store any details you provide for the purposes of fulfilling an order, effecting delivery of an order or purchase, or contacting you regarding an order or purchase.

I may also use your contact details to occasionally contact you directly about other matters relating to Simon Brock Handmade Leather Goods e.g. offers, developments etc. unless you ask me not to.

I will not pass any of your details on to third parties for any purpose whatsoever.

The website uses cookies for essential e-commerce functionality, and through the Google Analytics service which collects and stores information using cookies in order to track the duration, time, referring link and IP address of visits for the purpose of improving the user experience and effectiveness of the website. Sharing content using the ‘Share’ buttons on the product pages may also require storage of and access to targeting or advertising cookies that are linked to site functionality provided by other organisations.
